1. Introduction

This Privacy Policy explains how Shaperie, Inc. (“Shaperie”, “we”, “us”, or “our”) handles personal information collected through our website shaperie.com, our contributor platform, and any related services (together, the “Services”).

We process personal information in accordance with the Philippines Data Privacy Act of 2012 (Republic Act No. 10173), and, where applicable, the EU General Data Protection Regulation (GDPR) and the UK GDPR. By using the Services or submitting information through our forms, you acknowledge that you have read and understood this Privacy Policy.

2. Information we collect

2.1 Information you provide directly

  • Account & application data: full name, email address, phone number, country, primary language, weekly availability, and any free-text message you submit through our forms.
  • Contributor profile data: work history, language proficiency, areas of expertise, and assessment responses you complete when joining a project.
  • Communications: messages you send to [email protected], support tickets, and survey responses.
  • Payment details: bank account or e-wallet information required to pay you for approved contributions. Sensitive financial details are handled by our payment processors.
  • Tax & compliance documents: tax identification numbers or other documents required to comply with local laws where you live.

2.2 Information collected automatically

  • Usage data: pages visited, features used, task completion metrics, timestamps, and approximate session duration.
  • Device & technical data: IP address, browser type and version, operating system, device identifiers, and language settings.
  • Cookies and similar technologies: see Section 9 for details.

2.3 Information from third parties

  • Identity verification providers may share basic identity confirmation results with us.
  • Payment processors share transaction status and limited account information necessary to issue payouts.
  • Hiring partners may share applications you submitted through their platforms with your consent.

3. How we use your information

We use personal information to:

  • Evaluate applications and match contributors with appropriate projects.
  • Operate, maintain, and improve the Services and underlying technology.
  • Communicate with you about your account, tasks, payouts, and policy updates.
  • Process payments and meet related tax, accounting, and audit obligations.
  • Measure the quality, fairness, and accuracy of contributor output.
  • Detect, investigate, and prevent fraud, abuse, or violations of our terms.
  • Comply with applicable laws, regulations, and lawful requests from authorities.

4. Legal bases for processing (EEA / UK)

If you are located in the European Economic Area or the United Kingdom, we rely on one or more of the following legal bases under the GDPR / UK GDPR:

  • Contract: to onboard you, assign tasks, and pay you for approved work.
  • Legitimate interests: to secure the Services, prevent fraud, and improve our product, provided your rights do not override these interests.
  • Consent: for optional communications, certain cookies, and any processing that explicitly requires it. You may withdraw consent at any time.
  • Legal obligation: to meet tax, accounting, anti-money-laundering, and other regulatory duties.

5. How we share your information

We do not sell your personal information. We share it only when needed and only with parties that are bound by appropriate confidentiality and data-protection obligations:

  • Service providers that help us operate the platform, including hosting, analytics, email delivery, customer support, identity verification, and payment processing.
  • Client AI teams may receive contributor output (e.g., labels, ratings, written responses) but not your direct contact details, unless you explicitly opt in.
  • Professional advisors such as auditors, accountants, and lawyers, when necessary for our business operations.
  • Authorities when required by law, court order, or to protect the safety and rights of Shaperie, our contributors, or the public.
  • Successors in the event of a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

6. International data transfers

Shaperie operates globally. Your personal information may be transferred to, stored, and processed in countries other than your own, including the Philippines, the European Union, the United States, and other regions where our service providers are located.

Where applicable, we use appropriate safeguards such as the European Commission's Standard Contractual Clauses, equivalent UK transfer mechanisms, or other lawful transfer tools to protect your data.

7. Data retention

We retain personal information only for as long as necessary to provide the Services and meet the purposes described in this policy. Typical retention periods are:

  • Active contributor accounts: for the lifetime of the account plus up to 24 months after deactivation, for fraud-prevention and tax purposes.
  • Unsuccessful applications: up to 12 months, after which they are deleted or anonymized.
  • Payment and tax records: for the period required by applicable law, typically 5–10 years.
  • Support communications: up to 24 months after the last interaction.

After these periods, we delete or anonymize the data so it can no longer be associated with you.

8. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Delete your personal information (subject to legal exceptions).
  • Object to or restrict certain processing.
  • Withdraw consent where processing is based on consent.
  • Receive a portable copy of your data in a machine-readable format.
  • File a complaint with your local data protection authority. In the Philippines this is the National Privacy Commission (NPC).

9. Cookies and tracking technologies

We use cookies and similar technologies to operate the Services, remember preferences, measure usage, and improve performance. We use:

  • Strictly necessary cookies required for the site to function (e.g., login state).
  • Functional cookies that remember your preferences (e.g., language).
  • Analytics cookies that help us understand how the Services are used so we can improve them.

You can control cookies through your browser settings. Blocking strictly necessary cookies may prevent parts of the Services from working.

10. Children's privacy

The Services are not directed at children under 18, and we do not knowingly collect personal information from anyone under this age. If you believe a child has provided us with personal information, please contact us so we can delete it.

11. Security

We use administrative, technical, and physical safeguards designed to protect personal information against loss, theft, misuse, and unauthorized access. These include encryption in transit, access controls, audit logging, regular security reviews, and contractual obligations on our service providers.

No system is perfectly secure. If we become aware of a personal data breach that affects you, we will notify you and the relevant authorities as required by applicable law.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, notify you by email or through the Services. Continued use of the Services after the changes take effect means you accept the updated policy.
